How Illinois tax sales work

Sale Type
Tax Lien Certificate
Illinois sells tax lien certificates. The investor pays the delinquent taxes and receives a certificate that earns the interest or penalty set by state law. If the owner does not redeem, the holder asks the circuit court for a deed; for certificates sold since July 10, 2026 the court first orders a public auction where the holder is paid first.
Redemption Period
3 yrs — varies
At the annual tax sale the buyer gets a certificate of purchase, not the property. If the owner does not redeem in time, the buyer asks the circuit court for a deed; for certificates sold on or after July 10, 2026 the court first orders a public auction of the property, where the buyer holds a bid for what it is owed and anyone bidding more wins, with any surplus going to the former owner (35 ILCS 200/22-40, 22-42). Separately, counties resell land they already took by tax deed at their own sealed-bid auctions (35 ILCS 200/21-90), and many counties now take their whole annual sale themselves (35 ILCS 200/21-190).
Three years for property sold at the annual sale on or after July 10, 2026, but only one year for vacant non-farm land, buildings with 7 or more units, and commercial or industrial property. Certificates sold from January 2024 to July 9, 2026 run two and a half years. Land a county resells after taking its own tax deed carries no redemption.
Avg Property Tax Rate
2.27%
Above the national average (1.1%). Higher tax rates mean larger opening bids and lien amounts.
Homestead Rules
Special Rules Apply
Cook County has multiple exemptions. Lake County has separate rules.

Words used on this page

Redemption period
A window after the sale when the old owner can pay up and take the property back.
Tax lien
The county sells the unpaid tax debt, not the property. You collect interest, or later foreclose.

What can survive the sale and become yours

  • IRS federal tax liens
  • City of Chicago water liens
  • Building code violation fines

Other things to check

  • Annual-sale certificates: you bid the penalty down from a 9% ceiling, and the owner pays that penalty again for each six months that pass (35 ILCS 200/21-215, 21-355); redemption runs up to three years, so capital is locked a long time.
  • In 2026 many downstate counties are buying their whole annual sale themselves and offering only mobile homes to private buyers, so check the county first.
  • The properties most counties sell to the public are county-owned lots at sealed-bid resales, which come with a quitclaim deed and no redemption.
  • Cook County runs its own annual and scavenger sales.
  • Check for city water liens in Chicago properties.

How we rate these

Every listing says one of four things. Next to it is how many facts we hold for it, and what that much evidence is good enough for.

Worth a look
We hold the four basics (what is being sold, when, for how much, and what the property is) and nothing we hold argues against it. A claim about our record, not a promise about the property.
Needs review
We hold the basics, but a named finding wants a human first: a possible lien under the owner's name, a flood or environmental record, no mapped public road, a property check that fired, an opening bid at or above the value we hold for the parcel, or a sale the county reports as postponed.
Screened out
We hold positive evidence of a problem: recorded debt or an IRS lien that survives the sale, a lot too small to be a real parcel, a sale the county reports as over, or a sale date already past. The card names it.
Not enough data yet
One of the four basics is missing. This is not a bad rating: missing data can never produce a negative verdict.
N of 12 facts on file
How many of the 12 facts we track for this parcel we actually hold: sale kind, auction date, entry price, property class, value, lot size, living area, legal description, road access, title search, condition, sale terms. The same count on the board, the deal page and in Flexy. Hover the bar on any card to see which are still missing.

One number cannot say both how good a parcel looks and how much we actually know about it, and a low number reads as a verdict. So we do not print one. “Not enough data yet” is not a judgement about the property.

Illinois tax sale FAQ

Illinois is a tax lien state. At the annual tax sale the buyer gets a certificate of purchase, not the property.
