How New Mexico tax deed sales work

In New Mexico the state, not the county, runs tax sales under New Mexico state rules: it is a tax deed state with a redemption posture of no post-sale redemption.

Administrative (non-judicial) public auction conducted by the New Mexico Taxation and Revenue Department, Property Tax Division, once taxes have been delinquent three years (N.M. Stat. 7-38-65). No redemption after the sale; the deed can be challenged only within two years (7-38-70). The owner can stop the sale by paying in full, or signing an installment agreement, before 5:00 p.m. the day before the auction.

New Mexico sells the property, and the state runs the sale: the Taxation and Revenue Department's Property Tax Division auctions each county's parcels in person. Register with the auctioneer before the sale starts and pay in full before the auction ends. The deed carries no title warranty and leaves in place every mortgage, lien, lease or easement recorded before January 1 of the tax year, so a full title search is essential. Check water rights, land-grant (merced) boundaries, where the land grant's board may match the high bid, and pueblo land restrictions.
