How Tennessee tax deed sales work

Gibson County runs its tax sales under Tennessee state rules: it is a tax deed state with a redemption posture of 1 yr (varies). Counted from the court's order confirming the sale, not the auction: 1 year if the taxes were 5 years or less delinquent, 180 days if more than 5 but less than 8 years, 90 days if 8 years or more, and 30 days if the court finds the property vacant and abandoned (Tenn. Code 67-5-2701(a)).

Sold by the clerk and master in a court tax suit to the highest bidder. Ownership passes when the court confirms the sale, subject to the owner's right to redeem for up to one year from that order.

Tennessee is a redeemable-deed state. Delinquent taxes are collected through a lawsuit in chancery (or circuit) court, and the clerk and master sells the property to the highest bidder, with the taxes, interest, penalties and costs as the opening bid. Ownership passes when the court enters an order confirming the sale, and the redemption clock starts on that order: one year if the taxes were five years or less delinquent, 180 days if more than five but less than eight years, 90 days if eight years or more, and 30 days if the court finds the property vacant and abandoned. To redeem, the owner pays the taxes and costs plus 12% a year on your full purchase price, from the day you paid until the motion to redeem is filed. You cannot take possession without a court writ. A suit to set aside the sale must be filed within one year of the confirmation order, three years at most. Check for mineral rights in eastern Tennessee.
