How North Dakota tax deed sales work

Mercer County runs its tax sales under North Dakota state rules: it is a tax deed state with a redemption posture of 2 yrs.

North Dakota is a tax-DEED foreclosure state, NOT a lien-certificate state. Since 1999 the state has not permitted the sale of delinquent taxes to private lien-holders. The COUNTY forecloses its own tax lien: after the statutory delinquency period the county auditor serves a foreclosure notice, foreclosure date is October 1, and if unpaid the county takes a tax deed and becomes owner. The county then auctions the property to the public on the third Tuesday of November. No private tax-lien certificates exist; there is no post-deed redemption for the former owner once the county takes title.

ND is a lien state. County auditors manage tax lien process. Property must be delinquent 3+ years before county can take deed. Owner has extended redemption rights. Oil/mineral rights are significant in western ND — verify what transfers.
