How Alabama tax lien sales work

Madison County runs its tax sales under Alabama state rules: it is a tax lien state with a redemption posture of 3 yrs. Judicial redemption (AL Code §40-10-83) can extend indefinitely while the prior owner remains in possession — verify occupancy before bidding.

At the county tax sale the buyer gets a certificate of purchase, not a deed. The owner can redeem for three years from the sale (Ala. Code 40-10-120); after that the probate judge issues a tax deed when you turn in the certificate (40-10-29). Counties that hold a tax-lien auction instead sell a lien by bidding the interest down from 12%, and title comes through a circuit-court suit (40-10-184, 40-10-197).

AL has a 3-year redemption period from the date of sale (Ala. Code 40-10-120). For sales after January 1, 2020 the owner redeems by paying the bid plus 8% a year, and interest on an overbid is paid only up to 15% of the county's market value (40-10-122); older sales carry 12%. Tax sales are run by the county tax collector or revenue commissioner. A recorded mortgage or lien holder gets another year after you mail it notice of your purchase (40-10-120). Land the State bought in at past sales is sold separately by the Department of Revenue on a price quote.
