How New Jersey tax lien sales work

Cities and towns in Cape May County run their own tax sales under New Jersey state rules: it is a tax lien state with a redemption posture of until a court judgment. A private certificate holder can file to foreclose 2 years after the sale, the town after 6 months, and anyone at any time once the property is certified abandoned (N.J.S.A. 54:5-86). The owner can still pay the certificate off until the court enters final judgment.

Each town's tax collector sells tax sale certificates at an annual sale. A certificate is a lien, not the property. A private holder can file in Superior Court to foreclose the owner's right to redeem 2 years after the sale (the town after 6 months; anyone at any time if the property is certified abandoned). The owner can redeem until the final judgment (N.J.S.A. 54:5-86). Since July 10, 2024 the owner can demand, before judgment, that the property be sold at a sheriff's sale instead, and then keeps any surplus (P.L. 2024, c.39).

NJ is a lien state. Each town holds its own sale, many of them online at newjerseytaxsale.com. Bidding starts at 18% interest and goes down; once a bid reaches 0%, bidders offer a cash premium instead (N.J.S.A. 54:5-32). The premium earns no interest, comes back to you only if the certificate is redeemed, and goes to the town if it is not redeemed within 5 years (54:5-33). When the owner redeems you also get a one-time penalty: 2% of the certificate amount over $200, 4% over $5,000, 6% over $10,000 (54:5-61). Environmental contamination risk is significant.
